These Terms of Service (“Terms”) govern access to and use of My WashBoard, including its website, web application, mobile application, and related services.
My WashBoard is operated by RJ Lewis (“My WashBoard,” “we,” “us,” or “our”). By accessing or using My WashBoard, you agree to these Terms.
1. About My WashBoard
My WashBoard is a workforce and operations management platform designed primarily for businesses in the car wash industry. Features may include employee scheduling, operational assignments, checklists and tasks, attendance information, performance documentation, employee recognition, management forms, messaging, site, district, and regional dashboards, operational statistics, sales and performance information, third-party integrations, and other business-management tools.
My WashBoard is currently in beta and may change as development continues.
2. Organizations and Authorized Users
Organization means a business or other entity approved to use My WashBoard.
Authorized User means an employee, manager, administrator, owner, contractor, or other person permitted by an approved Organization to access My WashBoard.
These Terms apply to both Organizations and Authorized Users where applicable.
3. Approval Required
Organizations may not automatically obtain access to My WashBoard simply by registering. Organization access is subject to approval by My WashBoard.
We may approve or deny an application, request additional information, restrict available features, suspend access, or revoke approval. Employees and other users generally receive access through an approved Organization or authorized invitation process.
4. Beta Service
My WashBoard is currently offered in beta. During beta, features may be incomplete, changed, added, removed, interrupted, or reorganized as development continues.
Where a major change materially affects users, we may provide notice through the application, email, or another reasonable method. Beta access is currently provided without charge unless otherwise agreed.
5. Future Paid Services
My WashBoard may introduce paid subscriptions, plans, integrations, or premium features in the future. Users will not automatically be charged merely because they participated in the free beta.
Applicable pricing, billing terms, renewal terms, and cancellation rules will be disclosed before paid services begin.
6. Account Responsibilities
Users are responsible for maintaining the security of their My WashBoard accounts. Users must provide accurate account information, keep credentials confidential, use only accounts assigned to them, avoid unauthorized account sharing, promptly report suspected unauthorized access, and follow applicable authentication and security requirements.
Users may be responsible for activity occurring through their accounts where they fail to reasonably protect credentials or report unauthorized access.
7. Multi-Factor Authentication
My WashBoard may require multi-factor authentication based on user role, account privileges, organizational policy, security risk, or other security considerations.
MFA is expected to be required for higher-privilege roles including Organization Admin/Owner, Regional Manager, District Manager, and General Manager. My WashBoard may expand MFA requirements to additional roles. Users subject to an MFA requirement may be denied access until enrollment is completed.
8. Account Recovery
My WashBoard may establish account-recovery procedures designed to verify a user’s identity before restoring access. Recovery may involve email verification, time-limited codes or links, management approval, administrative review, MFA recovery procedures, session revocation, and password resets.
Higher-privilege accounts may be subject to additional verification. My WashBoard may temporarily restrict account recovery when suspicious or repeated failed recovery attempts occur.
9. Security Holds and Account Restrictions
My WashBoard may temporarily restrict, lock, or place a security hold on an account where reasonably necessary to protect the affected user, an Organization, other users, My WashBoard, platform data, or connected systems.
Security reasons may include suspected account compromise, unauthorized access, fraud, credential abuse, malicious activity, or security-policy violations. A security hold may temporarily block login, account recovery, or other account functions. My WashBoard may require a password reset, new authentication, MFA verification, or administrative approval before restoring access.
10. Shared Devices
Users may access My WashBoard from authorized shared workplace devices where necessary. When using a shared device, users must sign out when finished, avoid saving passwords, avoid allowing another user to access their account, and follow applicable workplace security procedures.
11. Organization Access Management
Organizations are responsible for keeping user access reasonably current. Organizations should promptly update access when an employee changes roles, transfers locations, receives increased or reduced authority, leaves the Organization, or no longer requires access.
My WashBoard may also automatically adjust access where approved workflows or integrations provide employment-status information.
12. Separation and Termination Access
Where an approved employee separation has a future effective date, access may remain available until that effective date. Once an approved separation becomes effective, My WashBoard may automatically deactivate the user’s access.
If a separation date passes while required approval remains incomplete, My WashBoard may temporarily restrict the affected account pending administrative review. Restricted users may be prevented from accessing all normal My WashBoard functions until the review is completed.
13. Acceptable Use
Users may use My WashBoard only for lawful and authorized purposes. Users may not use My WashBoard for illegal activity; harass, threaten, or abuse others; upload discriminatory or unlawfully harmful material; upload malicious software or code; attempt to disrupt the service; attempt unauthorized access; impersonate another person; commit fraud; circumvent access controls; interfere with security systems; or upload content they do not have the right to use.
My WashBoard may remove prohibited content or restrict access when necessary.
14. Intellectual Property
My WashBoard and its related technology are owned by My WashBoard and its operator or applicable licensors. This includes, where applicable, software, source code, application architecture, designs, interfaces, workflows, features, branding, logos, documentation, templates, and proprietary technology.
Use of My WashBoard does not transfer ownership of the platform to an Organization or user.
15. Prohibited Technical Activity
Except where applicable law expressly provides otherwise, users may not copy My WashBoard software, reverse engineer the platform, attempt to derive source code, scrape non-public data, circumvent technical protections, probe the service without authorization, use non-public My WashBoard technology to create a competing product, or redistribute proprietary portions of the service.
Authorized security testing requires prior written permission.
16. Organization Data
Organizations retain their rights in business and employee data they submit to My WashBoard. Organizations grant My WashBoard a limited right to host, store, process, back up, display to authorized users, secure, and otherwise use that data as reasonably necessary to provide My WashBoard.
This permission does not transfer ownership of Organization data to My WashBoard.
17. Organization Data Exports
A verified Organization Admin or Owner may request an export of eligible Organization data. Exports may include appropriate employee records, operational records, schedules, attendance information, performance records, forms, signatures, company files, and operational statistics.
Exports will not ordinarily include My WashBoard proprietary information, internal platform-security information, information belonging to other Organizations, or information that cannot lawfully be disclosed. Export activity may be audit-logged.
18. Organization Data Retention
If an Organization stops using My WashBoard, its eligible data may generally be retained for up to five years. This allows an Organization that later returns to potentially restore historical workspace information. Reactivation remains subject to My WashBoard approval.
After the applicable retention period, information may be reviewed for deletion. Information may be kept longer where reasonably necessary for legal obligations, litigation, legal holds, security investigations, contract enforcement, or regulatory requirements.
19. Early Organization Data Deletion
An Organization’s verified Admin or Owner may request deletion before the end of the normal retention period. Permanent deletion requires approval from My WashBoard’s Admin/Owner.
Deletion may be delayed or denied where information must reasonably be retained because of legal, security, contractual, investigative, or recordkeeping obligations. Deletion actions may be recorded in audit logs.
20. Employee Records
Deactivating or deleting a user account does not necessarily delete legitimate employment or workplace records. Records created through My WashBoard may remain in the Organization’s workspace according to applicable retention rules, contracts, policies, and law.
21. Service Availability
My WashBoard does not guarantee that the service will always be uninterrupted, error-free, or continuously available. Service interruptions may occur because of scheduled or emergency maintenance, software updates, Internet outages, hosting-provider interruptions, third-party service failures, security incidents, or circumstances outside our reasonable control.
My WashBoard will use reasonable efforts to maintain and restore the service.
22. Third-Party Services and Integrations
My WashBoard may rely on or integrate with third-party systems relating to car wash controls, human resources, payroll, authentication, hosting, databases, email, push notifications, file storage, analytics, maintenance, and other business systems.
My WashBoard is not responsible for outages, errors, delays, inaccurate information, changes, or failures originating from third-party providers. Third-party products and services may also be governed by their own terms.
23. Suspension or Termination
My WashBoard may suspend or terminate access where reasonably necessary because of security concerns, Terms violations, misuse, fraud, unauthorized activity, nonpayment when paid services are introduced, legal requirements, or risk to the platform or its users. Where appropriate, access may be restored after the issue is resolved.
24. Privacy
Use of My WashBoard is also governed by the My WashBoard Privacy Policy, which explains how personal information is collected, used, stored, disclosed, and protected.
25. Electronic Communications
Users agree that My WashBoard may provide service-related communications electronically, including through email, in-app notifications, push notifications, and account notices. Marketing communications will be handled according to applicable consent requirements and the Privacy Policy.
26. Electronic Records and Acknowledgments
My WashBoard may record electronic acknowledgments, signatures, acceptance events, and related audit information. Users agree that electronic records and acknowledgments may be used to document actions taken within the platform, subject to applicable law.
27. Disclaimer of Warranties
To the extent permitted by law, My WashBoard is provided on an “as is” and “as available” basis. My WashBoard does not guarantee that every feature will always function without error, the service will always be available, third-party data will always be accurate, every defect will immediately be corrected, or beta features will remain unchanged.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
28. Limitation of Liability
To the extent permitted by applicable law, My WashBoard will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the service, including losses resulting from service interruptions, third-party failures, lost productivity, integration errors, unauthorized account activity, or data supplied incorrectly by third parties.
Nothing in these Terms limits liability where such limitation is prohibited by law. Additional commercial liability terms may apply to future paid customers under separate customer agreements.
29. Changes to These Terms
My WashBoard may update these Terms as the platform develops. Material changes may be communicated through email, in-app notice, or another reasonable method. My WashBoard may require users to review and acknowledge updated Terms before continuing to use the service.
30. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable law requires otherwise. Disputes may be handled in an appropriate court located in Ohio, subject to any non-waivable rights or jurisdictional requirements provided by applicable law.
31. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
32. No Waiver
Failure by My WashBoard to enforce a provision of these Terms does not permanently waive the right to enforce that provision later.
33. Entire Agreement
These Terms, together with the Privacy Policy and any applicable Organization agreement, Data Processing Agreement, beta agreement, or other written agreement, form the applicable agreement governing use of My WashBoard.
If a separate written agreement conflicts with these Terms, the separate written agreement may control where it expressly states that it supersedes these Terms.
